Terms of service

These Terms of Service ("Terms") apply to your use of KMALL09 (kmall09.com.au, "we"/"us") and to purchases you make. By using the site or placing an order, you agree to these Terms. These Terms are governed by the laws of New South Wales, Australia, and nothing in them excludes, restricts or modifies any consumer right under the Australian Consumer Law (ACL).

1. Orders and acceptance

All orders are subject to our acceptance. We may decline or cancel all or part of an order (for example, for insufficient stock, pricing or listing errors, suspected fraud, or areas we cannot deliver to) and will refund in full in that case. Prices are in Australian dollars (AUD) and include GST.

2. Pricing and listing errors

Where there is an obvious pricing or product-information error, we may cancel and refund the affected order.

3. Partial out-of-stock orders

If part of your order cannot be supplied, we will fully refund those items and ship the remainder (this may be done without contacting you first). To cancel the whole order, contact us before dispatch. See our Refund Policy for details.

4. Delivery and passing of risk

Delivery is per our Shipping Policy. Risk and title pass to you on delivery. To the extent permitted by law, we are not responsible for loss or damage occurring after delivery has been completed (with proof of delivery); this does not limit your ACL rights.

5. Alcohol (18+)

Alcohol is sold only to persons aged 18 or over under the NSW Liquor Act 2007 (Licence No. LIQP770018418). It is against the law to sell or supply alcohol to a minor. We may require proof of age and photo ID on delivery, and may refuse to hand over alcohol if this cannot be verified.

6. Consumer guarantees and limitation of liability

Our goods and services come with consumer guarantees that cannot be excluded under the ACL. To the extent permitted by law, our liability for a breach of a consumer guarantee is limited, at our option, to re-supplying the goods or the cost of re-supply. Nothing in these Terms limits any right that cannot be excluded under the ACL.

7. Intellectual property

Trade marks, logos and content on this site belong to us or our licensors and may not be used without permission.
